TERMS OF USE (TOU)

ARTICLE 1 – PURPOSE

These Terms of Use (TOU) govern access to and use of the Stay Togo platform, published by Mart-IO Digital SARL U, which enables travellers to connect with accommodation establishments.

The platform notably allows:

•          Browsing listed establishments;
•          Searching for accommodation;
•          Booking accommodation;
•          Managing establishments by authorised managers.

Any use of the platform implies full and unreserved acceptance of these terms.

ARTICLE 2 – DEFINITIONS

For the purposes of these TOU:

Platform means the website and applications operated by Mart-IO Digital SARL U.

Traveller means any person searching for or booking accommodation.

Manager means any person authorised to administer an establishment.

Establishment means a hotel, aparthotel, hostel, guest house, furnished apartment, villa or any other accommodation offered on the platform.

Booking means any booking request made via the platform.

ARTICLE 3 – ACCEPTANCE OF THE TERMS

By creating an account or using the platform’s services, the user acknowledges having read these TOU and accepting them without reservation.

ARTICLE 4 – ACCESS TO THE PLATFORM

Access to the portal is free of charge.

Certain features require the creation of an account.

The platform is available 24 hours a day, 7 days a week, subject to interruptions required for maintenance or cases of force majeure.

ARTICLE 5 – ACCOUNT CREATION

The user undertakes to provide accurate information.

The user is responsible for:

•          The confidentiality of their password;
•          Use of their account;
•          All actions carried out from that account.

Any identity theft is prohibited.

ARTICLE 6 – MANAGER ACCOUNTS

Creating a Manager account does not automatically grant access to the management of an establishment.

Management rights are granted exclusively by Mart-IO Digital SARL U after verification of the applicant’s identity and their connection with the establishment concerned.

Mart-IO Digital SARL U may request any supporting documents necessary before validation.

ARTICLE 7 – LISTING OF ESTABLISHMENTS

Establishment listings may be created by Mart-IO Digital SARL U.

Publication of an establishment is subject to administrative validation.

Mart-IO Digital SARL U reserves the right to:

•          Correct obviously inaccurate information;
•          Suspend a listing;
•          Remove an establishment that does not comply with these terms.

ARTICLE 8 – MANAGERS’ OBLIGATIONS

The manager undertakes to:

•          Publish accurate information;
•          Keep availability up to date;
•          Display actual rates;
•          Use photographs that they are authorised to distribute;
•          Respond to bookings within reasonable timeframes.

Any false information may result in account suspension.

ARTICLE 9 – BOOKINGS

Bookings are made via the platform.

The establishment remains free to accept or refuse a booking in accordance with its availability and its own conditions.

The traveller is informed of the establishment’s decision.

ARTICLE 10 – TRAVELLERS’ OBLIGATIONS

The traveller undertakes to:

•          Provide accurate information;
•          Comply with the establishment’s rules;
•          Not use the platform for fraudulent purposes;
•          Respect the schedules and conditions communicated by the establishment.

ARTICLE 11 – PLATFORM LIABILITY

Mart-IO Digital SARL U acts exclusively as a digital intermediary between travellers and establishments.

As such, Mart-IO Digital SARL U:

•          Does not operate any establishment;
•          Is not a party to the accommodation contract concluded between the traveller and the establishment;
•          Does not guarantee the quality of the services provided by the establishments;
•          Cannot be held liable for the performance or improper performance of accommodation services.

ARTICLE 12 – ESTABLISHMENTS’ LIABILITY

Each establishment remains solely responsible for:

•          The accuracy of the information published;
•          The rates displayed;
•          Availability;
•          Reception of travellers;
•          The quality of the services offered.

ARTICLE 13 – INTELLECTUAL PROPERTY

All platform content (texts, logos, trademarks, illustrations, software, databases, graphical interfaces) is protected by intellectual property laws.

Any unauthorised reproduction or use is prohibited.

ARTICLE 14 – PERSONAL DATA

Personal data are processed in accordance with the Privacy Policy available on the platform.

ARTICLE 15 – ACCOUNT SUSPENSION

Mart-IO Digital SARL U may suspend or delete an account, in particular in the event of:

•          Fraud;
•          False declaration;
•          Abusive use of the platform;
•          Failure to comply with these TOU;
•          Compromise of system security.

ARTICLE 16 – AMENDMENT OF THE TERMS

Mart-IO Digital SARL U may amend these TOU at any time.

Users will be informed of material changes.

ARTICLE 17 – GOVERNING LAW

These TOU are governed by the law of the Togolese Republic.

ARTICLE 18 – DISPUTE RESOLUTION

The parties shall favour an amicable resolution of disputes.

Failing amicable agreement, the competent courts of the Togolese Republic shall have exclusive jurisdiction.
